Abstract

 تناولت هذه الدراسة المسؤولية الجنائية عن الإضرار بالمدنيين في الحرب في الفقه الإسلامي، هادفة إلى بيان رأيه فيها، وقد وقف الباحث على ماهية المسؤولية والكمين وعناصرهما وموقف الفقه الإسلامي منهما؛ فتبين أن القيام بالكمين في الحرب من الأعمال الجائزة والمشروعة فيها، وبأن قواعد الشريعة الإسلامية ومقاصدها العامة تقضي بمساءلة المتسبب بالإضرار بأرواح المدنيين من خلال نظام الديات وفق حالات معينة يجب معرفتها ومراعاتها.
