Torture of the Palestinian Prisoners and Detainees in Light of Israeli Practices and International Protection

Objectives: Torture is classified as a grave breach under the 1949 Geneva Conventions and as an international crime under the Rome Statute of the International Criminal Court. This study examines torture practices committed by the Israeli occupation against Palestinian prisoners and detainees, exposing the mechanisms used by the occupation authorities to legitimize these violations and shield perpetrators from accountability, in clear contravention of the international protections guaranteed to detainees.
Methodology: The study adopts a descriptive-analytical approach collecting and analyzing relevant information and extrapolating international conventions to derive results.
Results: Findings reveal that Israel systematically and widely practices torture against Palestinian detainees as part of a general policy supported by a legal framework that provides protection to perpetrators. The study also confirms Israel’s non-compliance with international humanitarian law and conventions prohibiting torture.
Conclusion: The study concludes that Israel commits international crimes by practicing torture against Palestinian detainees in violation of humanitarian law and the Rome Statute, requiring the prosecution of perpetrators before the International Criminal Court.
