The Burden of Proving Medical Error in the General Rules and Trends of Modern Jurisprudence and the Judiciary

If the patient were to get an appropriate compensation because of the
harm caused by wrong medical actions, he should give clear evidence of
the doctor’s error that breach him because he did not fulfill his obligations
and commitments imposed by his profession. Therefore, it is clear that in the
absence of a special law for medical responsibility and due to difficulties and
agonies facing the patient because he may lose his case in courts, and thus
the loss of his money. These factors show the importance of the intervention
of jurisprudence in an attempt to alleviate this burden through practical
solutions in the framework of general rules so as to ensure that the patient
who suffered will be compensated for any medical error.
