The Sessation of Paying back the Debts as a premise for the declaration of Bankruptcy: A Study in the Law of Bankruptcy no 3 (1976)

This study examines the cessation of paying back the debts as an
indication of a critical financial period for the debtor, who would endanger
his creditors’ rights. Therefore, lawmakers placed ultimate powers in the
court to decide whether such cessation justifies bankruptcy and to make a
decision on the beginning of the cessation of payment.
Judges in courts have the discretion to identify the illegal actions by
the debtor and therefore to declare a bankruptcy date before starting the
bankruptcy procedures.
This research will also examine the similarities and differences between
Palestinian bankruptcy law and other bankruptcy laws.
