Abstract

 

This study highlights the legal system that regulates the work of the Suez

canal as an international strait and Egypt’s Legal position as the controlling

state of the canal in the case of the breaking out of an armed conflict between

Israel and Iran.

This study will rely on important international treaties stemming from

the signing Constantinople agreement in 1888 and ending with the Israeli

Egyptian peace treaty signed in 1979.

This study will also Focus on the most important historical variables that

Egypt went through which were related directly to the Suez Canal such as, the

first world war and the tripartite aggression against Egypt in 1956, as well as

1967 war that caused the closure of the canal for 8 years. It is also important

to discuss the position of the Israeli Egyptian peace agreement in 1979 since

it is the last document that regulated the rules of passing the canal, finally

the study will analyze the law of seas general agreement that was signed in

Montego Bay in 1982.

Finally, this study concludes with necessary recommendations for

Egypt as it is the controlling state of the canal in order to take effective

measures to monitor it and guarantee that the canal will not be used for

military purposes.
