The Accountability of Mentally Disabled Persons and Underage Persons Regarding Crimes Committed by them in Islam

This research investigates the responsibility that falls upon children
and mad people as a result of committing a delict or a tort in Islamic Fiqih.
It opens with a brief chapter devoted to the explanation of what is meant
by a child and a mad person. The remaining chapters cover the following
topics of the research: attitude of Islam towards the lawful responsibility
that falls upon children and mad people, what these people should do when
committing a murder or an injury against another person, what should be
done when a child or a mad person shares the Mukallaf (a legally responsible
person under islamic law) in committing a delict, should one who got mad
after committing a delict be punished and what is the attitude of Islamic
shari’a towards children’s and mad people’s aggression upon others’ property
whether usurping or damaging it.
