This research deals with an important jurisprudence issue entitled
“incest and its punishment in Islamic jurisprudence - a comparative study”
It was based on four topics: the first devoted to the definition of incest and
its ruling; the second was devoted to those which incest includes and their
different types; the third to the sayings of scholars and the punishment of
those who commit incest ;and the fourth to overweighting and discussion. All
this was followed by conclusion and recommendations, The research found
that incest is more sinful when compared with other types of adultery. It was
also found that there is a disagreement among the scholars on the penalty for
incest, but they overweighed the killing and the confiscation of money of the
one who committed incest whether he was virgin or married.
