The Obligation of Freeing Muslim Prisoners

Prisoners’ release has always been a demand that all nations have
especially the Muslim nation which gives this issue a priority since releasing
prisoners is closely associated with Moslem’s doctrine and Shari’a.
Nowadays, Muslims form the biggest number of prisoners and their number
is seven thousand in Palestine. Consequently, releasing Muslim prisoners in
all means and approaches has been assured for its importance.
This research deals with the Islamic approach in releasing detainees.
It consists of an introduction, three chapters, and a conclusion and
recommendations. In the introduction, the research importance, objectives,
plans and previous studies have been presented. Also, the merit of resistance
(Jihad) since imprisonment is one of its results and the definition of the prisoner
and the importance of releasing him/ her have been discussed. Chapter Two
has been devoted to the scholars’ viewpoints in the judgment of prisoners’
release showing their evidences that support their release. Chapter Three
discusses ways of releasing prisoners .The results of the study have appeared
in the conclusion followed by the research important recommendations.
